Patrick has a Bachelor of Science in Aeronautics and has worked in aviation law for both the USA’s Federal Aviation Administration and New Zealand’s Civil Aviation Authority, as well as for the top airport law firm in the USA. He has also worked at a fixed-base operation (FBO) and in the marketing, scheduling, and pricing department of a regional airline. Patrick is active in aviation safety discussions and written articles for aviation law publications and spoken at aviation law conferences around the world.

Banking and Financial

We have years of experience working in-house at banks across New Zealand and can help you with your banking questions. We take a holistic approach to our advice, especially when it involves conduct and culture. We can explain how the different conduct regulations interact and provide advice on how to structure your conduct programme.

Our specialist areas include:

  • Banking (Prudential Supervision) Act 1989 and the Reserve Bank of New Zealand Act 2021. We have helped companies understand, monitor, and report on their Conditions of Registration and written submissions on proposed regulatory changes.
  • Privacy Act 2020.
  • Credit Contracts and Consumer Finance Act 2004. The CCCFA is our bread and butter. We created CCCFA obligations and controls registers, provided advice on potential CCCFA breaches, and worked with industry and regulators on various CCCFA matters.
  • Deposit Takers Act 2023. The DTA changes the landscape of banking and prudential regulation in New Zealand. The Deposit Compensation Scheme (DCS) introduced by the DTA brings New Zealand in line with other OECD countries in providing New Zealand depositors protection for the first time outside of an emergency. We drafted a key submission to Treasury that increased the DCS limit from $50,000 to $100,000. And we have key knowledge about how similar schemes work around the world.
  • Financial Markets Conduct Act 2013. The Financial Markets (Conduct of Institutions) Amendment Act 2022 and the Financial Services Legislation Amendment Act 2019 (FSLAA or FAR) changed the landscape for banks and financial institutions. We helped banks receive approval for their FSLAA licenses and created monitoring programmes to support FSLAA and CoFI compliance.

Commercial and Contracts

Contracts are often longer and less clear than they could be. We are skilled contract drafters and reviewers and can ensure the key information you need to convey is clear and conspicuous in your contract. We can also teach you and your team how we review contracts and the key issues that could cause issues for all parties in the contract.

Our experience includes drafting and negotiating contracts of all sizes: from your typical service contracts to the national air ambulance contract. We have also helped mediate contractual disputes and come to successful, non-litigious resolutions between parties.

Regulatory Affairs

Sometimes, companies need help working with regulators or drafting a compelling submission on regulatory change. These interactions can be time-consuming, complex, and detailed. Fortunately, we are specialists in regulatory affairs. We have years of regulatory experience, both working for regulators and working with private companies in their interactions with regulators.

Our typical approach on regulatory change is to summarise the proposed change in plain English and work with your business to understand the impact. We will highlight areas we see as concerns and listen to your business about areas where you have concerns. We will then draft a submission from your view in a persuasive manner that captures regulator attention. We cannot guarantee results. We have had fantastic responses from regulators on previous submissions, though, by tailoring our responses to key areas where small changes can make a big difference.

Risk and Compliance

About Patrick Wilson

Patrick graduated with a Bachelor of Science in Aeronautics from Saint Louis University’s Parks College of Aviation and Engineering. After working on the front lines of aviation for a couple of years, Patrick earned his Juris Doctorate from Vermont Law School. He moved to New Zealand in 2011 and has been licensed to practice in New Zealand since 2014.

In 2022, Patrick earned a mini-certificate in Real World Risk from the Real World Risk Institute.

Experience

Patrick is a senior leader and lawyer with a diverse range of experience, including intellectual property, aviation, regulatory investigation and litigation, banking and finance, oil and gas, international agreements, contract negotiation, and accident compensation. He is known for his clear and compelling communication and genuine care for the people he works with.

Additionally, Patrick worked as a bank’s Compliance Officer, creating and managing risk and compliance registers for the CCCFA, FMCA, and Prudential obligations. He conducted assurance reviews on areas including capital adequacy, liquidity, and governance requirements, and has great knowledge about bank capital adequacy and liquidity calculations.

Patrick has worked in almost every aspect of aviation: from customer service to marketing, pricing, and scheduling, to representing aviation clients as a lawyer. He is known as an approachable, knowledgeable, and pragmatic lawyer who always focuses on how he can best help his clients.
